1. Introduction and acceptance
Welcome to EdgeTK. These Terms and Conditions, which we call the "Terms", govern your access to and use of the EdgeTK website at edgetk.com, which we call the "Website", and your purchase and use of any products offered through it.
EdgeTK is an independently operated digital platform that designs and sells premium digital toolkits, templates, and frameworks for professionals across a range of disciplines. In these Terms, the words "EdgeTK", "we", "us", and "our" refer to the operator of the platform.
By accessing the Website, placing an order, or downloading any product, you confirm that you have read, understood, and agree to be bound by these Terms, together with our Privacy Policy, Cookie Policy, Refund Policy, and Shipping and Delivery Policy. Each of those policies is incorporated into these Terms by reference. If you do not agree with these Terms, please do not use the Website or purchase our products.
2. Definitions
To keep these Terms clear, the following words have the following meanings:
• Content: all text, templates, documents, designs, layouts, graphics, and other materials made available through the Website or contained within a Product.
• Products: the digital toolkits, templates, frameworks, and downloadable files we sell, delivered in formats such as Word, Excel, PowerPoint, PDF, and ZIP.
• Digital download: a Product delivered electronically, with no physical item produced or shipped.
• You and Customer: the individual or organization that accesses the Website or purchases a Product.
• Work product: the documents, deliverables, or materials you create by using, populating, customizing, or adapting a Product.
3. Eligibility
To use the Website and purchase our Products, you must be at least 18 years old and able to enter into a legally binding contract.
If you are purchasing on behalf of an organization, you confirm that you have the authority to bind that organization to these Terms, and references to "you" include that organization.
4. Our products and their digital nature
All Products are digital downloads. Nothing we sell is a physical item, and no physical goods are ever produced or shipped.
Products are delivered electronically and are intended for professional use as editable templates, frameworks, and reference materials.
Product descriptions, previews, and samples are provided to help you understand what each Product contains. We make reasonable efforts to describe our Products accurately, although minor differences in formatting or appearance may occur across different software versions, devices, and settings.
Our Products are professional tools and templates. They do not constitute legal, financial, consulting, or other professional advice. You are responsible for reviewing, adapting, and validating any Product before relying on it for your own purposes.
5. Orders, pricing, and payment
All prices are listed in United States Dollars (USD, "$") unless stated otherwise. You are responsible for any taxes, duties, or charges that may apply in your own country.
Prices may change at any time. Any change will not affect orders that have already been completed.
Payment is processed securely through our third-party payment providers, currently Tap Payment and PayPal Express Checkout. We do not collect or store your full payment card details.
By submitting an order, you authorize the relevant payment provider to charge the amount shown at checkout. An order is complete once payment is confirmed and the Product is made available to you for download.
6. Delivery
Products are delivered instantly as digital downloads through the Website and the order confirmation process. Full details are set out in our Shipping and Delivery Policy.
It is your responsibility to provide a valid email address and to ensure that you are able to receive emails and download files.
7. License to use our products
When your purchase is complete, and subject to these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, and perpetual license to use the Product you purchased for your own professional and business purposes.
Under this license, you may:
• Download, open, and store the Product for your own use.
• Customize, edit, and adapt the Product to suit your own projects, organization, or clients.
• Use the Product, and any Work product you create from it, internally within your organization and in the course of delivering services to your own clients or employer.
• Print and reproduce the Product for your own internal use.
• Apply your own branding to a Product for use in your internal work or client deliverables.
If you purchase as, or on behalf of, an organization, this license extends to that organization's internal use by its employees and contractors for the organization's own business purposes.
You may not:
• Resell, redistribute, sublicense, rent, lend, or give away the Product files, whether in their original or a modified form.
• Share, publish, or upload the Product files to any public or shared location, file-sharing service, marketplace, or template library.
• Use a Product, in whole or in part, to create, market, or sell a competing template, toolkit, or product.
• Present our Products as your own for the purpose of redistribution or sale, or claim authorship of the original Product.
• Remove or alter any copyright notice within a Product, except where you are rebranding a Product for your own permitted internal or client work.
Ownership of your Work product. The documents and deliverables you create by using or customizing a Product belong to you, and you are free to use them for your own and your clients' purposes. This does not transfer to you any ownership of the underlying Product, its structure, design, or original Content.
8. Intellectual property
All Products, Content, and the Website itself, including their design, structure, layout, text, and the EdgeTK name and brand, are owned by us or our licensors and are protected by copyright, trademark, and other intellectual property laws.
Purchasing a Product grants you the license described in Section 7. It does not transfer any ownership of intellectual property to you.
The EdgeTK name, the EdgeTK logo, and any associated product line names and marks are our trademarks. You may not use them without our prior written permission, except as they appear within a Product you have licensed.
We respect intellectual property rights and expect our users to do the same. If you believe that any Content infringes your rights, please contact us at contact@edgetk.com.
9. Prohibited use of the Website
You agree not to:
• Use the Website for any unlawful, fraudulent, or harmful purpose.
• Attempt to gain unauthorized access to the Website, its servers, or any data.
• Introduce viruses, malware, or any other harmful code.
• Interfere with, disrupt, or place undue load on the Website or its security features.
• Use automated systems to scrape, copy, or harvest Content without our permission.
• Circumvent any access controls, download limits, or usage restrictions.
10. Refunds
Because our Products are digital downloads delivered instantly, all sales are generally final. A small number of exceptions apply, and these are set out in full in our Refund Policy.
11. Third-party services and links
The Website relies on third-party services, including Shopify for hosting and checkout, and Tap Payment and PayPal for payment processing. The Website may also contain links to third-party websites.
We are not responsible for the content, policies, or practices of any third-party service or website. Your use of them is governed by their own terms and policies.
12. Disclaimers and no warranties
The Website and the Products are provided on an "as is" and "as available" basis.
To the fullest extent permitted by law, we disclaim all warranties, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.
We do not warrant that the Products will meet your specific requirements, that the Website will be uninterrupted or error-free, or that files will be completely free of defects. Our Products are professional templates and tools, not advice, and you are responsible for how you use them and for the outcomes of your own projects.
13. Limitation of liability
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, business, or goodwill, arising from your use of the Website or our Products.
Our total liability to you for any claim arising out of or relating to these Terms or a Product will not exceed the amount you actually paid for the Product giving rise to the claim.
Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law.
14. Indemnification
You agree to indemnify and hold us harmless from any claims, losses, liabilities, damages, and reasonable expenses arising from your misuse of the Website or our Products, your breach of these Terms, or your violation of any law or third-party right.
15. Changes to products, the Website, and these Terms
We may update, modify, or discontinue any Product or any part of the Website at any time.
We may also revise these Terms from time to time. The current version will always be posted on the Website with its "Last updated" date. Material changes take effect when they are posted, and your continued use of the Website after that point means you accept the revised Terms.
16. Termination
We may suspend or end your access to the Website if you breach these Terms.
The license granted to you in Section 7 may be revoked if you materially breach its restrictions.
Any provisions that by their nature should continue after termination, including those covering intellectual property, disclaimers, limitation of liability, and governing law, will remain in effect.
17. Privacy
Your use of the Website is also governed by our Privacy Policy and Cookie Policy, which explain how we collect, use, and protect your personal data. Please read them carefully.
18. Governing law and dispute resolution
These Terms, and any dispute or claim arising out of or in connection with them, are governed by and construed in accordance with the laws of the Kingdom of Saudi Arabia.
Any dispute relating to these Terms or your use of the Website will be subject to the exclusive jurisdiction of the competent courts of the Kingdom of Saudi Arabia, unless mandatory consumer protection laws in your country of residence require otherwise.
19. Consumer rights
If you are a consumer, you may benefit from mandatory protections under the laws of your country of residence. Nothing in these Terms removes or reduces any rights you hold under those mandatory laws that cannot be waived by agreement.
20. Force majeure
We are not liable for any failure or delay in performing our obligations that is caused by events beyond our reasonable control, including service provider outages, internet failures, cyber attacks, and acts of government.
21. General
Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full effect.
Entire agreement. These Terms, together with the policies referenced in them, form the entire agreement between you and us regarding the Website and our Products.
Waiver. If we do not enforce any provision of these Terms, this does not mean we waive our right to do so later.
Assignment. You may not assign or transfer your rights under these Terms. We may assign ours in connection with a transfer or reorganization of our business.
